"The Commission was established for the objective of providing a veneer of legitimacy to President Trump's false claim that he won the popular vote in the 2016 election _ once millions of supposedly illegal votes are subtracted from the count", the complaint states.

That's illegal, so yesterday the ACLU sued the president's election commission under a federal law created to ensure public accountability of advisory committees. In particular, it has special emphasis on open meetings, chartering, public involvement, and reporting. which requires all advisory committee meetings to be open to the public and timely noticed in the Federal Register.

The Commission came under fire recently after it sent a letter to all 50 states requesting an assortment of voter data, though that request has since been put on hold.

Prior to EPIC's restraining order request, the commission had already been rebuffed by many states, with 14 states and the District of Columbia having refused outright to provide any information and the remaining states either agreeing to provide the commission only with data that is available to the public, or supplying nothing pending review of their state laws to determine what data they can legally give the commission.

Alabama Secretary of State John Merrill noted the lack of information the state has been provided surrounding the commission's intent. Gardner has said that voting history is also public information.

The complaint calls the June 28 meeting of the commission "unlawful", noting that it did not provide notice in the federal register or make it open to the public.

County clerks have said that since the furor over the commission's data request spread last week hundreds of voters have been deleting their registration while a smaller number have been sealing their voter records as confidential. Numerous studies have found that voter fraud is rare, including one by the nonpartisan Brennan Center for Justice at the New York University School of Law, which determined an American is more likely to be struck by lightning than cast a vote illegally. EPIC also says the commission is asking the states to forward the data to an unsecure website, the Department of Defense Safe File Exchange site. Other states will provide data to the commission, but will withhold the partial Social Security numbers.

"We filed today's lawsuit because the so-called Election Integrity Commission has been operating covertly and its actions, to date, have been shrouded in secrecy", Kristen Clarke, president and executive director of the Lawyers' Committee for Civil Rights Under Law, said in a statement. The commission must also make all written records, documents, and meeting minutes available.

Some of the public uproar is more directed to the goal of this commission.

The White House did not respond to a request for comment on the lawsuits.

Arkansas has been the only state to comply.

Kobach, who is serving as vice chairman of the Presidential Advisory Commission on Election Integrity, is trying to sell voters on the profound lie that the nation's election system is fraught with fraud.

In the court filing Monday, Kobach said "the Commission has made a decision to use alternative means for transmitting the requested data".

The commission now faces a string of other lawsuits concerning transparency and privacy.

Maryland's State Board of Elections told the presidential panel last week that it would not comply with the request because disclosure of at least some of the information is prohibited by state law.
