Guy who sued date for texting during Guardians of the Galaxy defends himself

An Austin man is suing a woman for $17.31 after she allegedly texted throughout their movie date and left him at the theater, according to court documents.

According to a report by the Austin American-Statesman‚ 37-year-old Brandon Vezmar of Round Rock‚ Texas‚ filed a claim with the United States equivalent of the Small Claims Court for $17.31 (around R230) last week. He is seeking US$17.31, the price of the ticket to the Guardians of the Galaxy Vol 2 movie, he told the American-Statesman newspaper.

Vezmar said he asked her to stop, but the woman refused. Vezmar claims that, 15 minutes into the movie, his date (who remains anonymous) started texting and ignored Vezmar's request to turn off the phone after using it "10-20" times. So she did, and never came back.

Vezmar said he met the woman online and asked her out. He said it was "a first date from hell".

"I had my phone low and I wasn't bothering anybody", she said, adding that she had been texting a friend who was having a fight with her boyfriend.

He described the event as a "first date from hell" and said people texting inappropriately is one of his pet hates.

The woman also stated that she will be filing a protective claim against Vezmar as he contacted her little sister."This is insane", she said.

Vezmar went on to file the petition in the small claims court in Travis County. "His behavior made me extremely uncomfortable, and I felt I needed to remove myself from the situation for my own safety", she wrote.

"The date just didn't work out", she told him during the reunion. "I hope one day he can move past this and find peace in his life".

The CEO of the cinema has offered to compensate Vezmar with the amount in a gift certificate if he drops the lawsuit. "She deserves jail time!"
