Washington state moves to block Trump's new travel ban in court

In addition to Balderas, the Attorneys General of California, Connecticut, Delaware, Illinois, Massachusetts, New York, Oregon, Rhode Island, Vermont, Virginia and the Washington D.C. signed onto the lawsuit.

Hawaii filed its lawsuit two days after the new ban was announced, arguing that the order violates the U.S. Constitution and would have a "chilling" effect on the state's tourism industry.

The reworked executive order, unveiled earlier this month, blocks entry to the United States to people from six majority-Muslim countries for 90 days and temporarily shuts down the country's refugee program.

In Hawaii, which is alone in its lawsuit, the US government asked a federal court Monday to deny the state's request to temporarily block the ban from going into effect.

Chin's lawsuit claims the ban harms Hawaii by highlighting the state's dependence on global travelers, its ethnic diversity and its welcoming reputation as the Aloha State. In a friend of the court brief filed in Hawaii federal court, they implored the court to suspend Trump's new immigration order. Justice Department attorneys are also phoning in for the hearing.

"We're going to continue to fight this ban alongside our fellow states because, even after all the concessions President Trump made from the first ban to the second, it still remains a harmful, deeply un-American, and unconstitutional attempt to enact the Muslim ban he promised as a candidate", Herring said.

In court documents, the Justice Department argues the urgent request to block the order is unwarranted because "no immediate upheaval occurs as a result of the new order taking effect".

By filing an amended version of Washington's lawsuit, as opposed to a new lawsuit, the six states are able to keep the same trial judge.

"This order doesn't draw any religious distinction at all", said Jeffrey Wall, a government attorney. Unlike the earlier version, the March 6 order explicitly exempts from the ban natives of the targeted countries who have gained legal USA residency or hold valid US visas.

The hearing on the proposed temporary restraining order is being held in Honolulu on the day before the ban is scheduled to go into effect.

The new battle against Trump's order is being played out on several geographical fronts, but mainly on the west coast, which tends to be pro-Democrat.

In the brief, the groups railed against the travel ban writing that "the purported urgency of implementing the new travel ban is entirely unsupported by facts, data, or logical explanations that would justify such a dramatic reversal of American tradition".

President Donald Trump's revised ban on travelers from several Muslim countries has prompted a slightly smaller chorus of objections from major American technology firms compared to the furor over the first travel ban.

White House spokesman Sean Spicer said last week that the administration believes the revised travel ban will stand up to legal scrutiny.

“Informal statements by the president or his surrogates, ” before or after the election, “that do not directly concern the order are irrelevant, ” the government lawyers said.
